PHOTOGRAPHY AND VIDEOGRAPHY TERMS & CONDITIONS
1. Introduction
These Terms & Conditions govern the relationship between Izzat Najmi as professional shooter and the Client booking photography and videography services. By booking or using the Photographer’s services, the Client acknowledges that they have read and agreed to these Terms & Conditions.
2. Services Provided
The Photographer will provide photography and videography services as agreed with the Client, which may include but are not limited to:
- Photography and videography sessions for weddings, family events, individual portraits, or corporate events.
- Image editing services.
- Delivery of images in digital format.
3. Fees and Payment
- Service Fees: The cost of the services does not include transportation cost.
- Deposit: A deposit of RM100 is required to secure the booking. This deposit is non-refundable in case of cancellation or change of date by the Client.
- Balance Payment: The remaining balance must be paid in full before the event.
- Payment Terms: Payments can be made via cash or online banking.
4. Cancellation and Rescheduling
- Cancellation: If the Client cancels the booking, the deposit will not be refunded.
- Rescheduling: If the Client wishes to change the date of the photography and videography session, reasonable efforts will be made to reschedule to an alternate date. However, rescheduling may incur additional fees.
5. Copyright and Image Usage
- All images taken are the property of Izzat Najmi and team and are protected under copyright law.
- The Client is granted a license to use the images for personal purposes, such as prints or social media sharing. Any commercial use of the images requires written consent from the Photographer.
- The Photographer has the right to use the images in their portfolio, marketing materials, or on social media platforms.
6. Delivery of Images
- Delivery Timeframe: Images will be completed and delivered within 21 working days (maximum) following the photoshoot.
- Delivery Method: Images will be delivered via Google Drive or Pendrive.
- Image Format: The images will be provided in JPEG format, and in high resolution.
7. Client Responsibilities
- The Client is responsible for ensuring the location for the photoshoot is suitable and safe.
- The Client must cooperate during the photoshoot session and provide access to the location or individuals to be photographed.
8. Liability and Damages
- The Photographer is not liable for any loss, damage, or injury to property or persons during the photoshoot unless caused by the Photographer's negligence.
- All photography and videography equipment will be handled with care, but the Client should take appropriate safety precautions at the location.
9. Emergency Clause (Force Majeure)
In the event that Izzat Najmi (Izzatpawana) is unable to attend the event due to serious health issues or the death of immediate family members (parents), the Photographer will:
- Notify the Client as soon as possible.
- If a replacement cannot be arranged, a full refund of all payments made (including deposit) will be given to the Client.
This clause protects both the Photographer and the Client in unforeseen emergency situations beyond anyone’s control.
10. Dispute Resolution
In the event of any disputes related to the services, both parties agree to attempt to resolve the issue through mediation or arbitration before pursuing legal action. This agreement is governed by the laws of [Country/State].
11. Changes to Terms & Conditions
The Photographer reserves the right to change these Terms & Conditions at any time. Any changes will be communicated to the Client through the official website or directly in writing.
12. Severability
If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining sections will remain valid and enforceable.
13. Disclaimer
The Photographer is not responsible for circumstances beyond their control, such as bad weather or technical failures during the photoshoot.
14. Guest Telephone Policy
Guests or other individuals are not allowed to give direct instructions or telephones to the Photographer to take pictures.
15. Non-Disparagement Clause
The Client agrees not to disparage, defame, or make any negative statements about Izzat Najmi (Izzatpawana) and his team, whether verbally, in writing, on social media, or on any public platform.
If the Client engages in such actions that damage the Photographer’s reputation, image, or business, the Photographer reserves the right to take legal action, including but not limited to a defamation lawsuit and claim for damages.

TERMA & SYARAT FOTOGRAFI DAN VIDEOGRAFI
1. Pengenalan
Terma & Syarat ini mengawal hubungan antara Izzat Najmi sebagai jurufoto/juruvideo profesional dan Klien yang menempah perkhidmatan fotografi dan videografi. Dengan membuat tempahan atau menggunakan perkhidmatan Jurufoto, Klien mengakui bahawa mereka telah membaca dan bersetuju dengan Terma & Syarat ini.
2. Perkhidmatan Yang Disediakan
Jurufoto akan menyediakan perkhidmatan fotografi dan videografi seperti yang dipersetujui dengan Klien, termasuk tetapi tidak terhad kepada:
- Sesi fotografi dan videografi untuk majlis perkahwinan, acara keluarga, potret individu, atau acara korporat.
- Perkhidmatan penyuntingan imej.
- Penyerahan imej dalam format digital.
3. Yuran dan Pembayaran
- Yuran Perkhidmatan: Kos perkhidmatan tidak termasuk kos pengangkutan.
- Deposit: Deposit sebanyak RM100 diperlukan untuk mengesahkan tempahan. Deposit ini tidak akan dikembalikan sekiranya berlaku pembatalan atau penukaran tarikh oleh Klien.
- Baki Pembayaran: Baki penuh mesti dijelaskan sebelum acara berlangsung.
- Kaedah Pembayaran: Pembayaran boleh dibuat secara tunai atau perbankan dalam talian.
4. Pembatalan dan Penjadualan Semula
- Pembatalan: Sekiranya Klien membatalkan tempahan, deposit tidak akan dikembalikan.
- Penjadualan Semula: Jika Klien ingin menukar tarikh sesi fotografi/videografi, usaha wajar akan dilakukan untuk menjadualkan semula pada tarikh lain. Namun, caj tambahan mungkin dikenakan.
5. Hak Cipta dan Penggunaan Imej
- Semua imej yang diambil adalah hak milik Izzat Najmi dan pasukan serta dilindungi di bawah undang-undang hak cipta.
- Klien diberikan lesen untuk menggunakan imej bagi tujuan peribadi, seperti cetakan atau perkongsian di media sosial. Sebarang penggunaan komersial memerlukan kebenaran bertulis daripada Jurufoto.
- Jurufoto berhak menggunakan imej untuk portfolio, bahan pemasaran, atau platform media sosial mereka.
6. Penyerahan Imej
- Tempoh Penyerahan: Imej akan siap dan diserahkan dalam tempoh maksimum 21 hari bekerja selepas sesi penggambaran.
- Kaedah Penyerahan: Imej akan diserahkan melalui Google Drive atau pendrive.
- Format Imej: Imej akan disediakan dalam format JPEG, dengan resolusi tinggi.
7. Tanggungjawab Klien
- Klien bertanggungjawab memastikan lokasi penggambaran adalah sesuai dan selamat.
- Klien perlu memberikan kerjasama sepanjang sesi penggambaran serta menyediakan akses kepada lokasi atau individu yang ingin dirakam.
8. Liabiliti dan Kerosakan
- Jurufoto tidak bertanggungjawab ke atas sebarang kerugian, kerosakan, atau kecederaan kepada harta benda atau individu semasa penggambaran kecuali jika berpunca daripada kecuaian Jurufoto.
- Semua peralatan fotografi dan videografi akan dikendalikan dengan cermat, namun Klien perlu mengambil langkah keselamatan yang sesuai di lokasi.
9. Klausa Kecemasan (Force Majeure)
Sekiranya Izzat Najmi (Izzatpawana) tidak dapat hadir ke acara kerana masalah kesihatan serius atau kematian ahli keluarga terdekat (ibu bapa), maka Jurufoto akan:
- Memaklumkan Klien secepat mungkin.
- Jika pengganti tidak dapat diaturkan, semua bayaran yang telah dibuat (termasuk deposit) akan dipulangkan sepenuhnya kepada Klien.
Klausa ini melindungi kedua-dua pihak dalam situasi kecemasan yang tidak dapat dielakkan.
10. Penyelesaian Pertikaian
Sekiranya berlaku sebarang pertikaian berkaitan perkhidmatan, kedua-dua pihak bersetuju untuk menyelesaikannya melalui perbincangan, mediasi, atau timbang tara sebelum mengambil tindakan undang-undang. Perjanjian ini tertakluk di bawah undang-undang [Negara/Negeri].
11. Perubahan Terma & Syarat
Jurufoto berhak untuk mengubah Terma & Syarat ini pada bila-bila masa. Sebarang perubahan akan dimaklumkan kepada Klien melalui laman web rasmi atau secara bertulis.
12. Kebolehasingan (Severability)
Jika mana-mana bahagian Terma & Syarat ini didapati tidak sah atau tidak boleh dikuatkuasakan, bahagian selebihnya akan kekal sah dan berkuat kuasa.
13. Penafian
Jurufoto tidak bertanggungjawab atas keadaan di luar kawalan mereka, seperti cuaca buruk atau kegagalan teknikal semasa sesi penggambaran.
14. Polisi Tetamu (Guest Telephone Policy)
Tetamu atau individu lain tidak dibenarkan memberikan arahan terus atau menyerahkan telefon kepada Jurufoto untuk mengambil gambar.
15. Klausa Reputasi (Non-Disparagement)
Klien bersetuju untuk tidak memburukkan, memfitnah, atau menyebarkan kenyataan negatif mengenai Izzat Najmi (Izzatpawana) dan pasukan sama ada secara lisan, bertulis, di media sosial, atau mana-mana platform awam.
Sekiranya Klien didapati melakukan tindakan tersebut yang menjejaskan reputasi, imej, atau perniagaan Jurufoto, pihak Jurufoto berhak mengambil tindakan undang-undang termasuk tuntutan saman ganti rugi.
