PHOTOGRAPHY & VIDEOGRAPHY TERMS & CONDITIONS

Izzat Pawana (Izzat Najmi)

1. Introduction

These Terms & Conditions constitute a legally binding agreement between Izzat Najmi (Izzat Pawana) (“Photographer”) and the Client. By booking or using the Photographer’s services, the Client agrees to be bound by these Terms & Conditions.

2. Services Provided

The Photographer agrees to provide photography and/or videography services as agreed with the Client, including but not limited to:

• Wedding photography and videography
• Corporate and brand shoots
• Family and portrait sessions
• Event coverage
• Basic editing and post-production
• Delivery of final edited digital images/videos

All services will be performed in a professional manner consistent with industry standards.

3. Fees and Payment

Service Fees :

Service fees do not include transportation, accommodation, parking, or special location permits (if applicable). These additional costs shall be borne by the Client.

Deposit :

A non-refundable and non-transferable deposit of RM300 is required to secure the booking date. The booking is not confirmed until the deposit is received.

Balance Payment :

The remaining balance must be paid in full before or on the event date. Failure to complete payment may result in suspension of services or withholding of final deliverables.

Payment Method :

Payments may be made via cash or online banking transfer.

4. Cancellation and Rescheduling

Cancellation :

If the Client cancels the booking for any reason, the deposit will not be refunded.

Rescheduling :

Rescheduling is subject to availability. The Photographer will make reasonable efforts to accommodate a new date. Additional charges may apply. If the Photographer is unavailable on the new date, the booking will be treated as a cancellation.

5. Copyright and Image Usage

All images and videos remain the intellectual property of Izzat Najmi (Izzat Pawana) and are protected under copyright law.

The Client is granted a personal-use license only. This includes:

• Printing
• Sharing on personal social media

The Client may not:

• Sell images
• Use for commercial purposes
• Edit, alter, apply filters, or modify images
• without prior written consent from the Photographer.

The Photographer reserves the right to use images/videos for:

• Portfolio
• Website
• Social media
• Marketing and promotional purposes

6. Delivery of Images and Videos

Delivery Timeframe

Final edited images/videos will be delivered within 21 working days (maximum) after the shoot.

Delivery Method

Files will be delivered via:

• Google Drive
• Pendrive (if agreed)

Format

Images will be delivered in high-resolution JPEG format. RAW files are not included unless otherwise agreed.

The Photographer is not responsible for file loss after final delivery due to Client-side storage failure.

7. Client Responsibilities

The Client agrees to:

• Ensure the location is safe and accessible
• Obtain necessary permissions for shooting locations
• Cooperate during the session
• Inform the Photographer of important moments or specific requests in advance

The Photographer is not responsible for missed shots due to lack of cooperation or restricted access.

8. Liability and Damages

The Photographer is not liable for:

• Injury to persons
• Damage to property
• Loss caused by third parties

except in cases of proven negligence.

While all equipment is handled with care, the Client is responsible for ensuring a safe environment.

9. Force Majeure (Emergency Clause)

In the event the Photographer is unable to attend due to:

• Serious illness
• Death of immediate family members
• Accidents
• Government restrictions
• Natural disasters

The Photographer will:

• Notify the Client immediately
• Attempt to arrange a suitable replacement

If no replacement is available, a full refund including deposit will be issued.

10. Guest & Third-Party Interference

Guests or third parties are not permitted to give direct instructions to the Photographer. All communication must come from the Client or authorized representative.

11. Non-Disparagement

The Client agrees not to make false, defamatory, or malicious statements that may harm the reputation of the Photographer.

Any disputes shall be resolved privately according to the Dispute Resolution clause.

12. Dispute Resolution

Both parties agree to attempt mediation before pursuing legal action.

This agreement shall be governed by the laws of Malaysia.

13. Changes to Terms

The Photographer reserves the right to update these Terms & Conditions at any time. The latest version will be published on the official website.

14. Severability

If any provision is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
